These Terms and Conditions govern bookings made with Top Sahara (TopSahara.com) for private Morocco desert tours, shared desert tours, excursions, transfers, activities, accommodation arrangements, and other travel services.
By making a booking with Top Sahara, you confirm that you have read, understood, and accepted these Terms and Conditions on behalf of yourself and all travelers included in your booking.
Please read these terms carefully before confirming your reservation.

Throughout these Terms and Conditions, references to “Top Sahara,” “we,” “us,” or “our” mean [REGISTERED LEGAL COMPANY NAME], operating under the Top Sahara brand through TopSahara.com and providing the travel services described in your booking confirmation.
1. Booking & Confirmation
You may request or book a tour through our website, email, telephone, WhatsApp, or another communication channel operated by Top Sahara.
After receiving your request, we will provide the proposed itinerary, price, inclusions, exclusions, accommodation details where applicable, and any other relevant booking information.
A reservation is considered confirmed only after:
you have accepted the proposed itinerary and price;
we have received the required booking deposit; and
Top Sahara has sent you written confirmation of the booking.
Until the required deposit has been received and written confirmation has been issued, availability and prices cannot be guaranteed.
The person making the booking confirms that they are authorized to accept these Terms and Conditions on behalf of every traveler included in the reservation.
2. Prices
Tour prices are based on the services, number of travelers, accommodation category, transportation, activities, dates, and other arrangements stated in your quotation or booking confirmation.
Unless clearly stated otherwise, additional services requested after confirmation may result in an additional charge.
Your final booking confirmation provides the definitive price and list of services included in your reservation.
3. Deposits & Payment
A 50% deposit of the total booking price is normally required to secure and confirm your reservation, unless a different deposit amount is stated in your quotation or booking confirmation.
The deposit may be paid using the payment methods made available by Top Sahara, which may include:
credit card or online payment;
PayPal;
international bank transfer; or
another payment method agreed with our reservations team.
Any bank, card, transfer, or payment-processing fees charged by third-party payment providers may be the responsibility of the client unless otherwise stated.
Once the required deposit has been received, Top Sahara will send written confirmation of your booking.
The remaining balance must be paid according to the payment instructions stated in your confirmation. Where payment on arrival is permitted, accepted currencies may include Moroccan Dirhams, Euros, US Dollars, or British Pounds.
A booking is not considered fully paid until all amounts due have been received.
4. Cancellation by the Client
All cancellations must be communicated to Top Sahara in writing by email or WhatsApp.
The date on which we receive your written cancellation will be used to calculate the applicable cancellation charge.
Unless different cancellation conditions are clearly stated in your individual booking confirmation, the following charges apply:

For cancellations made more than 42 days before departure, any refund will be calculated after deducting non-refundable costs already committed to hotels, desert camps, transportation providers, activities, payment processors, or other suppliers.
Where a cancellation charge exceeds the deposit already paid, the client remains responsible for paying the outstanding cancellation amount where permitted by applicable law.
Any refundable amount will be returned using an appropriate payment method. Bank charges, currency-conversion differences, card-processing costs, and other non-recoverable third-party fees may be deducted where applicable.
We strongly recommend purchasing travel insurance that includes adequate trip-cancellation protection.
5. No-Shows & Unused Services
If you fail to arrive at the agreed departure location and time without informing us, your booking may be treated as a no-show.
No refund will normally be provided for:
no-shows;
late arrival resulting in missed services;
voluntarily leaving a tour after it has started;
unused accommodation;
unused meals;
missed activities; or
other services voluntarily declined during the trip.
Where possible, we will try to help travelers reconnect with their itinerary, but any additional transportation, accommodation, or other costs resulting from a late arrival or missed departure are normally the traveler’s responsibility.
6. Changes Requested by the Client
We understand that travel plans sometimes change and will make reasonable efforts to accommodate requests to modify:
travel dates;
departure or arrival cities;
accommodation;
itinerary;
activities;
number of travelers; or
other confirmed arrangements.
All changes are subject to availability.
Changes requested after confirmation may result in additional costs if hotels, camps, transportation companies, guides, activity providers, or other suppliers apply amendment or cancellation charges.
Where a requested change reduces the number of travelers, the per-person price may need to be recalculated because transportation and other private services are shared between fewer participants.
We will advise you of any significant additional charge before confirming the requested change.
7. Changes to an Itinerary
Morocco desert tours involve road travel through mountain, rural, and desert regions. Occasionally, circumstances may require reasonable changes to the planned itinerary.
Top Sahara may modify the order of visits, routes, departure times, accommodation, transportation, activities, or other arrangements when reasonably necessary because of circumstances such as:
severe weather;
flooding or snow;
road closures;
safety considerations;
mechanical problems;
government restrictions;
public events;
strikes;
supplier availability;
local conditions; or
other circumstances beyond our reasonable control.
Where a confirmed service becomes unavailable, we will make reasonable efforts to provide a suitable alternative of a comparable standard where possible.
Minor changes that do not materially affect the overall trip do not normally entitle the traveler to compensation.
8. Cancellation or Significant Changes by Top Sahara
In the unlikely event that Top Sahara must cancel your confirmed tour before departure for reasons within our control, we will normally offer, depending on the circumstances:
an alternative travel date;
an alternative itinerary of comparable value; or
a refund of payments received for the services that we are unable to provide.
Top Sahara is not responsible for separately booked services such as international flights, independent hotel bookings, visas, insurance, or other arrangements not purchased through us.
For this reason, we strongly recommend waiting until your travel arrangements are confirmed before purchasing non-refundable connecting services whenever possible.
9. Force Majeure
Top Sahara cannot guarantee the performance of services when travel becomes impossible, unsafe, or materially affected by circumstances outside our reasonable control.
Such circumstances may include, without limitation:
natural disasters;
earthquakes;
flooding;
severe weather;
fire;
epidemics or pandemics;
war or threat of war;
civil unrest;
terrorism or security incidents;
government restrictions;
border closures;
road closures;
strikes;
major transportation disruption; or
other extraordinary and unavoidable events.
In these situations, we will make reasonable efforts to assist travelers and provide appropriate alternative arrangements where practical.
Refunds, credits, additional costs, and alternative arrangements will depend on the circumstances, applicable law, and the refund conditions imposed by hotels, camps, transportation providers, activity operators, and other suppliers.
Nothing in these Terms limits any rights that cannot legally be excluded under applicable Moroccan law.
10. What Is Included & Excluded
The exact inclusions and exclusions for your trip are those stated on the relevant tour page, quotation, itinerary, invoice, or booking confirmation.
Depending on the selected tour, services may include:
private or shared transportation;
professional driver or driver-guide;
accommodation;
desert camp accommodation;
breakfast and/or dinner;
camel ride;
local guides;
airport or hotel transfers; and
activities specifically identified as included.
Unless explicitly stated as included, the tour price may exclude:
international or domestic flights;
travel insurance;
visa or passport expenses;
lunches and drinks;
entrance fees;
optional activities;
personal expenses;
gratuities;
additional accommodation;
services requested during the trip; and
expenses caused by circumstances outside the confirmed itinerary.
Your individual booking confirmation takes precedence when determining exactly what is included in your trip.
11. Accommodation
Accommodation is provided according to the category and arrangements stated in your confirmed itinerary.
We work with riads, hotels, guesthouses, kasbahs, and desert camps across Morocco. Individual properties may differ in size, layout, facilities, decoration, service style, and room configuration.
Requests concerning specific rooms, bedding configurations, adjoining rooms, views, or other preferences should be communicated before booking.
We will make reasonable efforts to accommodate such requests but cannot guarantee them unless specifically confirmed in writing.
If a confirmed accommodation becomes unavailable for reasons outside our control, we will make reasonable efforts to provide an alternative of a similar standard.
12. Transportation
Transportation will be provided according to the service described in your booking confirmation.
The vehicle used may vary depending on group size, route, availability, road conditions, and the type of tour booked.
Travel times stated in itineraries are approximate. Driving times can be affected by traffic, weather, road conditions, sightseeing stops, meal breaks, construction, mountain roads, and other circumstances.
Seat allocation in shared transportation may vary, and specific seats cannot be guaranteed unless expressly agreed in advance.
Travelers must follow reasonable safety instructions given by drivers, guides, and activity providers.
13. Activities & Desert Experiences
Some tours may include or offer activities such as camel riding, trekking, sandboarding, quad biking, hiking, or other outdoor experiences.
Certain activities involve inherent physical risks and may be affected by weather, terrain, health conditions, or local operating circumstances.
Travelers are responsible for deciding whether an activity is suitable for their physical condition and should inform us before travel of any relevant mobility requirements or other circumstances that may affect participation.
Activities provided by independent operators may also be subject to the operator’s own safety rules and participation conditions.
14. Children & Families
Children must be accompanied by a parent, guardian, or responsible adult.
Child prices, where available, depend on:
the child’s age;
selected tour;
accommodation arrangements;
room occupancy;
transportation requirements; and
services included.
Any applicable child discount will be confirmed before booking.
Parents or guardians are responsible for supervising children throughout the trip.
If you require an appropriate child seat or have other family travel requirements, please inform Top Sahara before confirming your reservation so availability can be checked.
15. Special Requests, Dietary Requirements & Accessibility
Please inform us before booking about any important requirements relating to:
dietary restrictions;
food allergies;
reduced mobility;
accessibility;
room configuration; or
other travel requirements that could affect the services you need.
We will make reasonable efforts to communicate these requirements to hotels, camps, restaurants, guides, and other relevant suppliers.
However, not every request can be guaranteed, particularly in remote mountain or desert areas where facilities may be limited.
16. Passports, Visas & Entry Requirements
Each traveler is responsible for ensuring that they have the correct passport, visa, immigration documents, permits, and other documentation required for travel to Morocco.
Passport validity and visa requirements vary according to nationality and may change.
Travelers should therefore verify the latest requirements with the appropriate Moroccan embassy, consulate, immigration authority, or other official government source before traveling.
Top Sahara cannot accept responsibility for denied entry, missed travel, additional expenses, or other consequences resulting from incomplete, expired, damaged, or otherwise insufficient travel documentation.
17. Travel Insurance
Travel insurance is not included in the price of our tours unless specifically stated otherwise.
We strongly recommend that every traveler obtains comprehensive travel insurance before departure.
Appropriate insurance should consider coverage for:
medical treatment;
emergency evacuation and repatriation;
trip cancellation;
trip interruption;
delayed travel;
lost or damaged luggage;
personal belongings; and
outdoor or adventure activities included in your itinerary.
It is the traveler’s responsibility to understand the conditions and exclusions of their insurance policy.
18. Health & Fitness
Travelers are responsible for ensuring that they are reasonably fit to participate in the services and activities included in their chosen itinerary.
If you have mobility requirements or other circumstances that may affect your ability to participate in a particular activity, please inform us before booking so that we can advise whether reasonable arrangements may be available.
Travelers should seek appropriate professional advice concerning health requirements for international travel when necessary.
19. Traveler Conduct
Travelers are expected to behave respectfully toward drivers, guides, accommodation staff, local communities, other travelers, and service providers.
Top Sahara reserves the right, subject to applicable law, to refuse or discontinue services to a traveler whose conduct seriously endangers themselves or others, damages property, causes significant disruption, or involves unlawful or abusive behavior.
In such circumstances, additional expenses resulting from the traveler’s conduct may be their responsibility.
20. Personal Belongings
Travelers are responsible for taking reasonable care of their luggage, passports, money, electronic devices, valuables, and other personal belongings.
Please check vehicles, hotels, restaurants, and camps carefully before leaving.
If an item is lost, we will make reasonable efforts to help locate it, but recovery cannot be guaranteed.
Any shipping, courier, or delivery costs associated with returning recovered property are normally the responsibility of the traveler.
21. Complaints & Problems During Your Tour
If you experience a problem during your trip, please inform your driver, guide, hotel, camp, or Top Sahara representative as soon as possible.
Reporting a problem promptly gives us the opportunity to investigate and, where possible, resolve it while your trip is still in progress.
If the issue cannot be resolved during your trip, please submit your complaint to us in writing and include your:
name;
booking reference;
travel dates;
description of the issue; and
any relevant supporting information.

22. Responsibility & Liability
Top Sahara, operated by [REGISTERED LEGAL COMPANY NAME], is responsible for arranging the travel services confirmed in your booking in accordance with applicable law.
We work with accommodation providers, drivers, guides, desert camps, restaurants, activity providers, and other suppliers to deliver different elements of an itinerary.
Travelers are also responsible for following reasonable safety instructions and complying with local laws and regulations.
Top Sahara will not be responsible to the extent permitted by applicable law for loss or damage resulting from:
the traveler’s own actions or omissions;
failure to follow reasonable safety instructions;
circumstances that could not reasonably have been avoided or prevented;
services independently booked by the traveler and not forming part of the Top Sahara booking; or
events falling within the force majeure provisions described above.
Nothing in these Terms and Conditions is intended to exclude or restrict responsibility that cannot legally be excluded under applicable Moroccan law.
23. Privacy & Personal Information
Top Sahara collects and processes personal information necessary to manage inquiries, reservations, payments, accommodation, transportation, and other travel arrangements.
To provide your trip, certain information may need to be shared with relevant service providers such as:
hotels and riads;
desert camps;
transportation providers;
guides;
activity providers; and
payment processors.
We do not sell travelers’ personal information.

24. Photography
Our team may occasionally take photographs or videos during a tour.
We will respect requests from travelers who do not want their image used for Top Sahara’s website, social media, or promotional materials.
If you prefer not to appear in photographs or videos used for promotional purposes, please inform our team.
25. Website Information
We make reasonable efforts to ensure that the information published on TopSahara.com is accurate and current.
However, itineraries, accommodation, photographs, travel times, activities, prices, and other information may occasionally change because of supplier updates, seasonal conditions, operational requirements, or circumstances outside our control.
Your written booking confirmation is the definitive record of the services and price included in your individual reservation.
26. Governing Law
These Terms and Conditions and bookings made with Top Sahara, operated by [REGISTERED LEGAL COMPANY NAME], are governed by the applicable laws of the Kingdom of Morocco.
Any dispute that cannot be resolved amicably will be handled by the competent Moroccan courts in accordance with applicable law.
Nothing in this section removes any mandatory consumer rights or protections available under applicable legislation.

Top Sahara may update these Terms and Conditions from time to time to reflect changes in our services, booking procedures, legal requirements, or operating practices.
The version applicable to your booking will normally be the version in effect when your reservation is confirmed, unless a change is required by applicable law.
